Terms and Conditions

1. Acceptance of Terms

By downloading, installing, or using the Private Pictures mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Pranikash OPC Private Limited ("Company," "we," "our," or "us").

2. Description of Service

Private Pictures is a mobile application that allows users to:

• Encrypt and protect images securely
• Protect images with password-based access control
• Share encrypted images with others
• Control whether recipients can save images
• Revoke access to shared images at any time
• Purchase Privacy Credits for premium features

3. User Accounts

3.1 Account Creation

To use the App, you must create an account by signing in. You agree to:

• Provide accurate and complete information
• Maintain the security of your account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App.

3.3 Account Termination

You may request to delete your account at any time by contacting us at support@unii.in. We may suspend or terminate your account if you violate these Terms.

4. User Responsibilities

You are solely responsible for:

• The content of images you encrypt and share
• Remembering passwords you set for encrypted images
• Sharing passwords only with intended recipients
• Managing access controls for your shared images
• Complying with all applicable laws and regulations

5. Disclaimer of Responsibility for Image Sharing

You acknowledge and agree that we are not responsible for any misuse of your images in the following circumstances:

• Unintended Recipients: If you accidentally share a protected image (.ppic file) with the wrong person, or if someone gains unauthorized access to your shared file
• Password Disclosure: If the password is obtained by a recipient through coercion, social engineering, guessing, or any other means
• Downloaded Images: If you have not disabled the download option and the recipient saves the image and uses it for any purpose, including harmful or illegal purposes
• Screen Capture: If someone captures the decrypted image using another device (e.g., photographing the screen with another phone)
• Rooted/Jailbroken Devices: If someone takes screenshots or screen recordings on a rooted, jailbroken, or otherwise modified device that bypasses screenshot restrictions
• Screen Recording Software: If someone uses screen recording applications or tools to capture the decrypted image

While we provide tools to help protect your privacy, no technology can guarantee complete protection against all forms of misuse. You are solely responsible for exercising caution when sharing sensitive images and choosing trustworthy recipients.

6. Prohibited Uses

You agree not to use the App to:

• Share illegal content, including but not limited to child exploitation material
• Distribute malware, viruses, or harmful code
• Infringe on intellectual property rights of others
• Harass, threaten, or harm other individuals
• Engage in fraud or deceptive practices
• Violate any applicable laws or regulations
• Attempt to reverse engineer, decompile, or hack the App
• Circumvent security features or access controls
• Use automated systems or bots to access the App
• Resell or commercially exploit the App without authorization

We reserve the right to report illegal content to appropriate authorities and cooperate with law enforcement investigations.

7. Privacy Credits

7.1 Credits System

Privacy Credits are virtual items that can be purchased within the App. Credits can be used to:

• Save/download a received image (1 credit per image)
• Disable saving for recipients (1 credit per image)
• Disable viewing/decryption for recipients (1 credit per image)

7.2 Purchases

All purchases are processed through the respective app store. By making a purchase, you agree to their terms of service.

7.3 Refunds

Credit purchases are generally non-refundable. Refund requests must be submitted through the respective app store. We may grant refunds at our discretion for unused credits.

7.4 Credit Expiration

Privacy Credits do not expire as long as your account remains active.

8. Intellectual Property

8.1 Our Intellectual Property

The App, including its design, code, features, and content, is owned by Pranikash OPC Private Limited and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8.2 Your Content

You retain ownership of images you encrypt using the App. By using the App, you grant us a limited license to process your encrypted metadata as necessary to provide the service.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• UNINTERRUPTED OR ERROR-FREE SERVICE
• SECURITY OF TRANSMITTED DATA

We do not guarantee that:

• The App will meet your specific requirements
• The App will be available at all times
• Encrypted images will be completely secure against all attacks
• All bugs or errors will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRANIKASH OPC PRIVATE LIMITED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Unauthorized access to or alteration of your data
• Statements or conduct of any third party
• Any other matter relating to the App

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the past 12 months, or INR 1,000, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pranikash OPC Private Limited and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Content you share through the App

12. Modifications to Service

We reserve the right to:

• Modify or discontinue the App at any time
• Change features, pricing, or credit costs
• Limit or restrict access to certain features

We will provide reasonable notice of significant changes when possible.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, if:

• You breach these Terms
• We are required to do so by law
• We discontinue the App

Upon termination, your right to use the App ceases immediately. Provisions that should survive termination will remain in effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.

15. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at support@unii.in. We will attempt to resolve the dispute within 30 days.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.

18. Changes to Terms

We may update these Terms from time to time. We will notify you of changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an in-app notification for significant changes

Continued use of the App after changes constitutes acceptance of the new Terms.
